NOTICE OF RULEMAKING HEARING

February 27, 2019

ATTENTION: The Nebraska Energy Office has changed the date for the hearing on proposed repeal of N.A.C. Title 105 — Renewable Tax Credit; and, N.A.C. Title 109 — Debarment procedures for Participants in School Energy Efficiency Loan & Program Grants. The hearing originally schedule for January 15 at 10 AM has been changed to February 27 at 1 PM at the same location the Nebraska Energy Office, 521 South 14th Street, Suite 300, Lincoln, NE. NOTICE  is hereby given that the Nebraska Energy Office will hold a rule-making hearing pursuant to Neb Rev. Stat. §84-1411 on Wednesday, February 27, 2019 at 1:00 PM Central Time at the Nebraska Energy Office Conference Room at 521 South 14th Street, Lincoln Nebraska Suite 300.

The purpose of the hearing to take testimony and evidence about repeal of Title 105, Chapters 1-6 Renewable Energy Tax Credit, and Title 109, Chapter 1 Debarment Procedures for Participants in School Energy Efficiency Loan and Grants Programs. This notice is made pursuant to Neb. Rev. Stat. §§84-907 and 84-1414 and the agency’s action is consistent with the authority granted by law. The subject matter and scope of the rule-making action is: the rules are no longer necessary due to the repeal of the authorizing statute.

The agenda and a draft copy of the proposed regulations scheduled for hearing are also available at the NEBRASKA ENERGY OFFICE’s Lincoln office, 521 South 14th Street, Lincoln Nebraska Suite 300. A statement of the fiscal impact of the proposed repeal, which is no expected fiscal impact from repealing these regulations, is also available at these locations.

All interested persons may attend and testify orally or by written submission at the public hearing. Any person may provide advance notice of intent to testify by contacting Ed Holbrook, at NEBRASKA ENERGY OFFICE, P.O. Interested persons may also submit written comments to Ed Holbrook prior to the hearing, which will be entered into the hearing record if received at the Lincoln office by 5:00 P.M. CT, February 27, 2019.

Hearing Agenda

1:00 p.m. Thomas Tabor, Division Chief, for the Nebraska Energy Office will open the hearing. Public hearing attendees must sign in on the attendance sheet to make public testimony or comments.
This is a Public Hearing for the Nebraska Energy Office Rulemaking Hearing Pursuant to Neb Rev. Stat. §84-1411, to take testimony and evidence regarding the repeal of Title 105, Chapters 1-6 Renewable Tax Credit, and Title 109, Chapter 1 Debarment Procedures for Participants in School Energy Efficiency Loan and Grants Programs. In accordance with Nebraska State Law a copy of the Open Meetings Act is accessible to members of the public. Public notice of this public hearing was published on December 16, 2018 in the Omaha World Herald. The purpose of the Public hearing is to receive comments on the repeal of Title 105, Chapters 1-6 Renewable Tax Credit, and Title 109, Chapter 1 Debarment Procedures for Participants in School Energy Efficiency Loan and Grants Programs.
Attendees will please state their name and organization before making comments.  Attendees then testify regarding the repeal of Title 105 and 109. Testimony is recorded.
With all public comments in, and in accordance to the Nebraska Open Meetings Law under Neb. Rev. Stat. §§84-1408 to 84-1414 all comments will be recorded and if necessary the public body shall by roll call vote in open session vote by either yeas and nays on any action taken on any question or motion duly moved and seconded. If there are no actions or motions, comments will be recorded and repeal of Title 105, Chapters 1-6 Renewable Tax Credit, and Title 109, Chapter 1 Debarment Procedures for Participants in School Energy Efficiency Loan and Grants Programs will be pursued.
If no one is in attendance If this public hearing does not have anyone from the public present for comment, the public hearing will take a 15-minute recess for possible late attendees. If there are no public attendees at that time, the recess and public hearing will end.
After 15-minutes, if no one from the public makes comments on the repeal of Title 105 and 109 and seeing that there are no written public comments regarding the repeal of Title 105, Chapters 1-6 Renewable Tax Credit, and Title 109, Chapter 1 Debarment Procedures for Participants in School Energy Efficiency Loan and Grants Programs, the Nebraska Energy Office will pursue the repeal of Title 105 and 109 and the public hearing will officially close.
